Tibetan court rules in favor of Penpa Tsering in case no. 20

DHARAMSHALA, October 14: In the much awaited verdict this afternoon in the high profile case no 20, the Tibetan Supreme Justice Commission (TSJC) ruled in favour of Penpa Tsering, the ousted former representative at the Office of Tibet, Washington DC.

The case was filed in May 2018, largely sparked by publication of a 10-point clarification on official websites of CTA for terminating the service of plaintiff from the Office of Tibet, Washington DC in November 2017.

The verdict that lasted almost five hours in which the Chief Justice Commissioner Kargyu Dhondup went through minutes of the case, the plaintiff was acquitted from the charges formulated as eight issues of law and two issue of facts in the case.

Talking to the media afterwards, the plaintiff said although he won the case, there is no inspiration to celebrate as it is against the cabinet and spoke of the need for measures to prevent such compulsion in the future and for the community to rise above it.

The plaintiff was able to prove all five points where as the defendant team failed to prove any of the 14 points required of it by the court.

The Chief Justice Commissioner held that the defamatory allegations made against the plaintiff were unsubstantiated, ordered the defendant to issue apology and clarification the same way through the CTA official outlet.

The defendant also needs to compensate INR 98,700 for the lawyer fees of the plaintiff.
